I purchase properties in packages. I obtain all records from banks
and public information records. When I list a property I believe all
information is accurate but not guaranteed. I clearly stated on this
auction any bidder must do there due diligence BEFORE placing a bid. You
have a responsibility to verify all information BEFORE making your
decision to place your bid not after.
Whatever information you found yesterday (5 days after the auction
ended) through public records, could have and should have been done
before the auction ended. You are responsible for relying on your own
information.
You mentioned you would consider the property with an adjusted
price agreed on, the winning bid was $1,025, what you you suggest?
This site charges sellers a fee for listing on this site, when
bidders bid without being sure of there purchase it is costly and time

I sent you an email with the listing ticket attached to show you the information I had. That listing ticket was only sent to you to assure you that I did not falsify any information. The properties I purchase are off the market but at one time the bank was selling them and this is the exact information they use. Mr. Hamilton, my auction page was very clear, it stated that all information listed by the seller is believed to be accurate but not guaranteed. I have no reason to believe the bank would give me false information. This auction was listed for FIVE DAYS. Within 5 days all bidders have enough time to do your research and make there decision based on there findings. All property information is a matter of public record to all. During our last conversation you mention you saw the property listing only 3 hours before the auction ended. Do you sincerely feel less then 3 hours is enough time to conduct your own due diligence? Do your partners feel less then 3 hours is enough time to conduct due diligence? With these auctions the property is sold to the highest bidder. Once the auction is over a nonrefundable deposit is due and the winning bidder is stating they intend on closing in a timely manner as stated in the auction listing. When I accept a deposit that means any offer by any other potential buyer will not be accepted. You came in at the last minute and placed your bid, outbidding other interested bidders and other parties. I lost potentional buyers due to the fact you made a rush decision and placed your bid at the last minute without responsibly doing your own research. How ever you obtained the information that caused you not to continue with the closing, it should have been done prior to you placing your bid. We have not met or communicated previously. I hope you forgive my
late entry to this unfornate situation. Having just returned from a
rather lengthy trip, I am just catching up on email. I have reviewed
the correspondence between you and brother Hamilton. It appears you
have reached something of an impasse, with you holding a significant
amount of earnest money, proffered in good faith toward the ultimate
purchase of this real estate. It is sad that Detroit is in such a state
that we are discussing a real estate transaction in terms of such
meager amounts. Sadder still that such good intentions are being
sidelined by this kind of disagreement.
In reviewing the attachments to your last email, I see that
you knew that the house was vinyl, but that you continue to represent it
as a brick house. Further, your contention that Mr. Hamilton's due
diligence should have included, in essence, doubting your word, seems to
us an unfortunate indictment of character. We want to believe you do
not intentionally mislead us or others regarding the outstanding levies
against the property or its construction elements, or that you would
retain "trust money" based on a less than honest representation of the
property in question, no matter how unintentional. Please help us
to maintain our attributing to your character the highest of
consideration.
Mr. Hamilton has offered to share in the expense of the listing.
We would hope you accept this offer, returning the balance of his
earnest deposit, and relisting the property accurately, or simply
execute a quit claim deed to him with no further consideration. The
cost of executing a quit claim deed, as you know, is virtually nothing.
