We have a problem. You had assured me there were no taxes or other payments due on this property. Additionally, the property was represented and listed by you and purchased by us as a two-story brick bungalow, which it appears it isn't.
As to taxes, according to the Detroit City Assessor's Ofice as of today, May 17, there is $1,908.47 currently due which includes $458.40 of unpaid water and sewer bills. Also, the home is vinyl sided and not brick as was claimed.
We ask that you provide proof of your claim that all back taxes etc are paid and that no other fees are due currently or in arrears.
As to the vinyl vs. brick issue, we would consider an adjusted price for the house if reasonable.
If you cannot provide, we request a full and timely refund of our $500.00 earnest money previously paid.

I purchase properties in packages. I obtain all records from banks and public information records. When I list a property I believe all information is accurate but not guaranteed. I clearly stated on this auction any bidder must do there due diligence BEFORE placing a bid. You have a responsibility to verify all information BEFORE making your decision to place your bid not after.

Whatever information you found yesterday (5 days after the auction ended) through public records, could have and should have been done before the auction ended. You are responsible for relying on your own information.

You mentioned you would consider the property with an adjusted price agreed on, the winning bid was $1,025, what you you suggest?

This site charges sellers a fee for listing on this site, when bidders bid without being sure of there purchase it is costly and time consuming.

Hope you are staying productive and happy. By your websites I can see you are likely a very active person, on the go and full of interests and goals. Anyway, to get to the point of this email.

These were the arguments discussed last night by our church groups regarding the 4421 Fischer Street house.

Negatives:
1. Not a two-story house. Even a 1.5 story house typically has 4' eaves at perimeter walls. This probably has a developed attic, which was deemed suitable for our needs and would have a lower tax assessment.
2. Not brick exterior, but vinyl.
3. Probably an unfinished basement.
4. Vandalism of the property is assumed.
5. Has tax, water and sewer bills due and payable. Taxes were transferred to Wayne County for collection.

Positives:
1. Within our price range for purchase.
2. Within the area of intended service to the east Detroit community.
3. Suitable for residence for up to three persons working with the community from this location.
4. Unfinished basement is not a concern.
5. In this neighborhood, substantial vandalism has probably occurred but at this price that would be acceptable as part of the package.
6. Major bus routes operating all day long from each end of the block.
7. Presence of numerous area churches, community services, medical facilities, parks and at least one major public library within two to ten blocks distance.

As it was with bidding and information gathering relative to the purchase, I am again entrusted to find a cordial conclusion in discussing or ending this offer.
I will call you Tuesday afternoon unless we hear from you sooner.
Sorry this deal is being difficult for each of us, but I hope perhaps you may have another property in the same area with better circumstances. We can discuss that option.

Dear eBay- Our ministry group won the bid on a house described as being two-story with no taxes due, per the seller. We made our deposit in good faith only to learn the property is not two-story nor made of brick and that there are indeed taxes and other bills due at present. As you pointed out, we needed to verify information about the house. I believe we did our "due diligence." We didn't realize we needed to verify whether or not your answers to our questions about the house and taxes were correct. We trusted you when you said it was a brick house with no taxes or other financial encumbrances. We believed you, because you would certainly would have known the facts. You would not have originally bought the house without knowing.

We again ask for a refund of our deposit on the property. I have learned that eBay's fee for listing a property for sale, in this case, was probably $100.00 - which I have already told you we would allow you to keep out of a sense of fairness. We will just consider it the price of a lesson learned and we may all remain friends.

Failing to accept our offer of what we feel is a fair and equitable close to this matter, there will be no other course open to us but to report this to eBay, Capital One Credit, AlertPay, Better Business bureaus in certain cities and online, and other agencies. We really don't want to have to do that, and we believe your reputation in business is worth far more than what we ask as a settlement - a return of our earnest money, paid in good faith that you were selling a property as originally described by yourself.

Please - do the right thing.

As I previously stated to you that all information I list is believed to
be accurate. I purchase properties in packages so I do not physically
visit each one personally. I obtain my property records from the MLS
system. This is the same information the banks have and use. I sent you
an email with the listing ticket attached to show you the information I
had. That listing ticket was only sent to you to assure you that I did
not falsify any information. The properties I purchase are off the
market but at one time the bank was selling them and this is the exact
information they use.

Mr. Hamilton, my auction page was very clear, it stated that all
information listed by the seller is believed to be accurate but not
guaranteed. I have no reason to believe the bank would give me false
information. This auction was listed for FIVE DAYS. Within 5 days all
bidders have enough time to do your research and make there decision
based on there findings. All property information is a matter of public
record to all.

During our last conversation you mention you saw the property listing
only 3 hours before the auction ended. Do you sincerely feel less then 3
hours is enough time to conduct your own due diligence? Do your partners
feel less then 3 hours is enough time to conduct due diligence?

With these auctions the property is sold to the highest bidder. Once the
auction is over a nonrefundable deposit is due and the winning bidder is
stating they intend on closing in a timely manner as stated in the
auction listing. When I accept a deposit that means any offer by any
other potential buyer will not be accepted. You came in at the last
minute and placed your bid, outbidding other interested bidders and
other parties. I lost potentional buyers due to the fact you made a rush
decision and placed your bid at the last minute without responsibly
doing your own research.

How ever you obtained the information that caused you not to continue
with the closing, it should have been done prior to you placing your bid.

Mr. Hamilton your irresponsible actions caused me to lose business, not
to mention waste my time. My terms were clear and you are not going to
adjust them to make it suitable for you, then offer me what you feel I
should accept.

I don't know what "listing ticket" you refer to as having been sent; I
sincerely believe nothing has been received as an attachment to any of
your emails. As to your listing the property on eBay with the
information you said you had received, it is not my responsibility to
verify that you understood it or that it was correct. I acted, in good
faith, on information you yourself provided either on the eBay website
or over the phone in our conversations.

I assume that since you closed your last email (shown below) "Warmest
Regards" that we are still able to communicate in a calm and amicable
manner. Again, all we are asking is a return of our $500 deposit less
the (assumed) $100 listing fee you had incurred with eBay. We won't make
this offer again.

We have already heard from eBay and AlertPay, and, to put it gently,
they appear to think that advertising certain details of an item that
aren't correct is questionable. Other agencies are being informed of the
matter. Please, let's end this in a friendly fashion while we may.

I am still praying for each of us, and for a peaceful conclusion to this
